U.S. Coast Guard Implements Emergency Safety Zone in Honolulu for Oversized Crane Transport

The U.S. Coast Guard has implemented a critical temporary safety zone in the navigable waters of Mamala Bay, Honolulu, Hawai'i, effective immediately, to safeguard personnel, vessels, and the marine environment during the complex transit of oversized cargo. This protective measure, detailed in a temporary final rule by the Captain of the Port Sector Honolulu, became essential following unforeseen delays in the arrival of three massive ship-to-shore cranes destined for Honolulu Harbor.

Background to the Emergency Measure

The genesis of this safety directive lies in the planned transportation of three crucial ship-to-shore cranes by Pasha Hawaii. These cranes originated from Los Angeles, California, with their initial arrival in Honolulu anticipated by August 14, 2026. The initial schedule prompted the Coast Guard to publish a temporary final rule, establishing a safety zone for the period of August 13 through August 17, 2026, as documented in the Federal Register. However, maritime operations are inherently vulnerable to environmental factors. Tropical Storm Lala intervened, causing a significant disruption and delaying the transit of the tug and barge carrying this formidable cargo. The updated arrival date for the T/V DENISE FOSS and its tow, FOSS 3612, was then reset to August 19, 2026, necessitating a prompt revision of the safety protocols.

Rationale for Expedited Rulemaking

The Captain of the Port Honolulu determined that the tug and barge, burdened by the exceptionally large ship-to-shore cranes, would experience significant restrictions in its ability to maneuver. This inherent limitation created a substantial hazard to other vessels and persons on the water during the approach to Honolulu Harbor in Mamala Bay. To mitigate these identified risks and ensure the safety of all maritime traffic, the COTP invoked its authority under 46 U.S.C. 70034 to establish the safety zone. The urgent nature of this requirement also led the Coast Guard to bypass the standard public notice and comment period for rulemaking. Citing good cause under 5 U.S.C. 553(b)(B), the agency found that it was impracticable to solicit and respond to comments given the critical timeframe. The updated arrival notification was received on August 17, 2026, leaving insufficient time for a conventional rulemaking process before the required enforcement date of August 19, 2026. Similarly, immediate effectiveness less than 30 days after publication was justified under 5 U.S.C. 553(d)(3) for the same pressing safety concerns.

Specifics of the Safety Zone

The temporary safety zone encompasses all navigable waters extending within a 500-yard radius around the T/V DENISE FOSS, with official number 1254223, and its tow, FOSS 3612, with official number 1255436. This moving safety zone is active as the vessels transit Mamala Bay on their approach to Honolulu Harbor. During the enforcement period, entry into this designated area is strictly prohibited for all vessels and persons. The only exception is with explicit authorization from the Captain of the Port Sector Honolulu or their officially designated representative. Mariners requiring such authorization are instructed to contact the COTP or their representative via VHF-FM channel 16 or by telephone. Those within the zone must comply with all lawful orders. The enforcement of this temporary rule commenced at 6 a.m. on August 19, 2026, and is scheduled to remain in effect through 9 a.m. on August 25, 2026. Enforcement will conclude once the T/V DENISE FOSS and its tow have successfully entered the Honolulu Harbor Security Zone.

Regulatory Considerations and Compliance

Beyond the immediate safety imperative, the Coast Guard conducted its due diligence regarding various regulatory analyses. The agency determined that the rule would not have a significant economic impact on a substantial number of small entities, thus exempting it from the full requirements of the Regulatory Flexibility Act. Furthermore, it found no new collection of information would be necessitated under the Paperwork Reduction Act. Consistent with Executive Order 13132 on Federalism and Executive Order 13175 concerning Consultation and Coordination with Indian Tribal Governments, the rule was deemed to align with fundamental federalism principles and to have no substantial tribal implications. The Unfunded Mandates Reform Act was also considered, with the Coast Guard certifying that the rule would not result in an annual expenditure of $100,000,000 or more by governmental bodies or the private sector. Lastly, an environmental analysis conducted under the National Environmental Policy Act found the action to be categorically excluded from further review, affirming that it does not individually or cumulatively have a significant effect on the human environment.
