Updates to the New Markets Tax Credit Program Application

You might care about this because the Department of the Treasury is asking for public feedback on updates to the application form used for the New Markets Tax Credit Program. This program gives tax credits to investors who put money into low-income communities. To receive these credits organizations must first be certified as a Community Development Entity. The application form for this certification is getting updated. The changes include removing certain structure references, asking for more details about affiliates and foreign interests, adding questions about government investigations, and including stricter checks against fraud and discrimination. The Treasury Department wants public comments on these changes before the end of December 2026.

The updates to the application form show a shift in how the government monitors groups that want to help low-income areas. By asking for more details on affiliate ownership and past government investigations, the Treasury Department wants to protect public funds and ensure rules are followed. The form removes mentions of minority-owned structures while adding new questions about foreign interests and anti-discrimination laws. These updates will change what information applicants must provide before they can get tax credits for community projects.

This notice matters most to groups that apply for certification as Community Development Entities. This includes non-profit organizations, for-profit companies, and state or tribal groups that invest in low-income neighborhoods. Legal professionals who help clients with tax credits or community development will also want to read the changes. Furthermore, members of the public who care about tax credit programs and government oversight can submit comments on the new form before the December deadline.
